Part 1 · Using this website
1About this site
The site describes my services, prices and past work. The live demo and the example dashboards use made-up data. The case studies describe my own past coaching, teaching and research work, without naming the programs involved.
Prices on the site are starting points. A project's final price is set only by a written quote that you approve.
2Using the site
You may browse the site, try the live demo and share links to it. You may not copy its design, code or text to present as your own, or use it in a way that harms the site or other visitors.
3Other companies and links
Kelley Connect is not affiliated with or endorsed by the NFL, Google, Microsoft or any other company named on this site. Product names such as Google Sheets and Microsoft Excel belong to their owners and appear only to describe what my work connects to.
Links to other sites, such as LinkedIn, are there for convenience. I do not control those sites and am not responsible for their content.
4No promises about the site
The site is provided as is, for general information. I work to keep it accurate, but I do not promise that it is complete, current or free of errors.
Part 2 · Working together
These terms apply to every project unless your signed quote or contract says otherwise.
5Quotes and scope
Every project starts with a written quote that lists what I will build, the timeline and the price. A quote is valid for 30 days.
Anything not listed in the quote is a change. Changes are quoted before any work on them starts.
6Payment
Projects are billed 50% to start and 50% at launch. Work is scheduled once the deposit clears.
- You can pay by card or US bank account through Stripe's secure checkout, or by check. Apple Pay and Google Pay also appear at checkout on devices set up for them.
- Invoices are due within 14 days of the invoice date.
- Care plans are billed monthly at $150, and hourly work is billed at $50 per hour.
- Hosting and domain costs, if any, are passed through at cost.
- If an invoice is more than 30 days late, I may pause work until it is paid.
- Payment details never change by email. If a message says they have, call or text (317) 316-9610 to confirm before you pay.
7What I need from you
Timelines depend on getting your data, answers and feedback when the quote says. When something from your side arrives late, the launch date moves by the same amount of time.
8Changes and revisions
Each package includes the rounds of changes listed on the site and in your quote. Further rounds are billed hourly or quoted as a change.
9Who owns the work
Once a project is paid in full, you own the finished app, dashboards and reports I made for you. You always own the data you provide. Your quote lists what you receive at launch, such as the app files and the accounts the app runs on.
I keep ownership of the general tools, templates and code that I use across projects. You receive a permanent license to use them as part of your project. Outside software, such as open-source libraries, stays under its own license.
I never show your project, name or logo publicly without your written permission.
10Confidentiality and data
I keep your non-public information confidential and use it only for your project. Data you share is handled as described in the Privacy Policy and the Student and Athlete Data rules.
11Fixes and support after launch
If something I built does not work the way the quote describes, tell me within 30 days of launch and I will fix it at no charge.
The Full Platform package also includes 30 days of support after launch. After that, the optional care plan covers up to 3 hours of updates, data refreshes and fixes each month. Unused hours do not carry over. You can cancel the plan at any time, and it ends with the month already paid.
12Ending a project
Either of us can end a project with written notice, and email counts. You pay for the work completed up to that point at $50 per hour, never more than the quoted price.
The deposit counts toward that amount, and I refund any part of it that was not used. You receive the work completed so far once it is paid for.
13Limits of liability
Apart from the fix promise above, the work is provided as is. I do not guarantee any particular result, such as wins, enrollment or revenue.
To the extent the law allows, my total liability for any claim about a project is limited to the amount you paid me for that project. I am not liable for indirect losses, such as lost profits. Nothing in these terms limits liability that the law does not allow to be limited.
14Independent business
I work as an independent business, not as your employee or agent. I am responsible for my own taxes, equipment and software.
15Governing law
These terms are governed by the laws of Indiana. Any dispute will be handled in the state or federal courts located in Indiana.
If your organization requires its own contract or data privacy agreement, that document controls where it differs from these terms.
16Changes to these terms
I may update these terms, and the date at the top shows the current version. A signed quote keeps the terms that applied on the day it was signed.
